There have been some discussion within the Blogosphere regarding this. Are you responsible for comments made by your readers, someone else on your blog or your site? Are you as the blog owner or website owner liable to get sued if the comments made has a slanderous or defamation intention in nature?

Yes. If I were to answer those question based on what make sense to me, then it would be yes. The reason behind this is the fact that you have the power, the access to remove those comments made on your blog or site. Unless somehow your blogging software system, Wordpress, Blogger, Typepad or whatever it is were designed in a way that you do not have access to manage, (edit or delete) comments made on the site, if not then yes you are liable.

You are responsible for all the contents within the site or the domain you own regardless of who or where the contents come from. If the contents is illegal or ill mannered then you, the one with the access to your site, should have removed it.

YouTube for example have been faced with tons of legal problems with it’s users submitting copyrighted materials on to it’s website. Why is it that the sharks lawyers when after YouTube? This is because YouTube having absolute control on what items being posted on it’s site, on it’s domain, has the power to remove the content. YouTube is working hard removing tons of copyrighted materials every single day.

The above example are also applicable for other types of services. This is why, if you even bothered to read the terms and agreement when signing up for a service on the web, it stated that they reserve the right to remove anything that they find illegal or are breaking the term and agreement and/or terminate your account.

When it comes to your blog and the comments made, you are responsible for it even if it is writen by someone else. If something illegal in nature was posted you should take the necessary steps to remove it from your website.
